OK.. here is the story. My mum has full compo car insurance with NRMA. In Jan this year, she had an accident with a van which was her fault.
The van that she hit didn't even had that much damange, couple of panel/bumper dings etc. So we went through the claim and everything and things seems sweet. Now some 7 month later, the f**kwit is filing legal action against my mum claiming the van was a business vehicle (which was true), and he's out of pocket 8 grand for renting a hire vehicle. So we forward the letter and everything to NRMA a few weeks ago thinking they'll look after us, but today we just got another letter today saying this person at NRMA does not acknowledge that NRMA indemnifies us in relation to this matter. So i'm going to have to call NRMA again tomorrow and demand a explanation? Any one on this forum have any experience with low life trying to claim compo such as this or have any legal background so I can take some ammunition with me? |

me no. but it seems your best bet is to hassle the shiz out of NRMA.
But i would guess your defence would be that you went through all the right precedures. NRMA were the ones that took so long and the van driver didnt notify you in any case telling you to hurry up or anything. as i see it NRMA is the middle man and was ment to do all the business etc. thats why you pay them. anyways keep us posted PS get a good lawyer |

Hey mate - I suggest you see some legal advice, generally - the most expensive advice is actually free advice because it is often incorrect for your situation.
I would suggest you read the thread that was posted earlier in the week about personal issues that was in the NSW section but unfortunately it's been deleted. Don't ask ill-informed forumites for advice. -------------------- |

something that i have always found amusing is how some people will have a work vehicle but not insure it. i mean if your livelyhood depends on it, then it must be worth the few hundred dollars a year to insure it.

yeah. i say the same thing to people that buy bikes and say that they don't have/want a helmet cause they don't worry about the cops. i say it's better to buy the helmet than to get the $75 fine then have to buy a helmet anyway.

as some know, i just had an accident in my car (was hit by someone - their fault) and my car is a company car... i had to get the company director to write a letter stating that i required a car for work, detailing my job description to satisfy the request, and sent it to the other parties insurance company... now i'm rolling in a rent-a-car while i wait for mine to get fixed...
based on that, i'd say it's the responsibility of the guy driving the van to provide a similar letter, or at least some sort of request to the insurance company at the time of the accident for a substitute vehicle... surely he can't claim something like that months down the track... -------------------- |

far out that sucks!! similar thing happened to me. every now and again i do some work for my uncle who owns a transport/freight company, which deals with lots of big farm/mining equipment to be transported. anyways i had to drive the escort vehicle for a wide load, this was the 1st time i'd ever done it and was kinda thrown in the deep end!! i was bringing up the rear (travelling in a busy part of port adelaide), escorting the truck through an intersection, flashing lights etc etc, all traffic had stopped and the truck was just going through the intersection, i was following about 15 metres or more behind (you have to be that far behind to be able to see!) was just going through the intersection when this p plater girl comes flying in front of me, i take her out with my bull bar! Lucky i reacted in time to slow right down! did a bit of damage to her car but nothing serious. my escort car was fine...
anyways a few months later after we thought it was all sorted out, it turns out them or their insurance company (not sure which one) are suing us for quite a few thousand for 'repairs'... even tho even i could see that her car had maximum of $2000 dollars damage! it was a crappy old toyota camry... point is it really sucks when you find out aages later that you are being sued for something ridiculous! -------------------- ...bring on the wakeboarding and summer!!...
